(247_,i_zelAd it/W-/4 <br /> 7 / a <br /> CITY COUNCIL WORK SESSION <br /> MAY 10,1995 6:00 P.M. <br /> --OUTLINE-- <br /> Problem--Balls coming over out-field fences from Silver View Park ball <br /> diamonds and hitting houses of Silver Lake Woods homeowners. <br /> Several pieces of siding and a window have had to be replaced. <br /> Background--Several-meetings and discussions among-SLW homeowners <br /> and city officials have taken place, including at least one <br /> presentation at a City Council meeting. <br /> --City installed an orange "snow-fence" atop the berm in 1994 <br /> and again in 1995. <br /> --Gene Wagner (SLWHA Pres.) met with Mary Saarion, Rick <br /> (Forester), and two others atop the berm by the balifield on <br /> May 18, 1995 to review the problem and discuss options. <br /> Solution--All at the meeting on 5-18-95 agreed a "green wall of 15 Black <br /> Hills Spruce, properly placed, would provide an effective and <br /> visually pleasing solution to the problem. The total cost would <br /> be approx. $200.00 per tree or $3000.00 in all. <br /> City Position--There is no money budgeted for this item and the city is not <br /> legally liable for damage to property or homeowners in this <br /> case, therefore, nothing more will be done. <br /> SLWHA Position--Any organization (SLWHA, VFW, Bridgemans or the City of <br /> Mounds View) must assume responsibility for damage <br /> to neighbors caused by the activities allowed or sponsored <br /> by that organization. <br /> --SLWHA members pay approx. $250,000.00 in property <br /> taxes each year with about $45,000.00 (18%) going to the <br /> City of Mounds View and $4500.00 (10%) of the city's <br /> share to the Park Board. We need only about $3000.00 <br /> to correct a problem which is serious and is not going to <br /> go away. <br /> --Is it possible to get a copy of the legal opinion which <br /> absolves the City of any liability? Research by SLWHA <br /> legal people indicates this position can be challenged. <br /> Request--Install 15 trees on top of the berm in locations which will provide <br /> a "green wall" of protection for nur SLW homeowners. <br />
