Mr. Downing was <br /> the owner of Lot 2, Block 1 Downing Addition (please see attached area <br /> map for location of property) . <br /> Chapter 1010. 08 Subdivision 1 c of the Mounds View Municipal Code <br /> requires the issuance of a Wetland Alteration Permit for ". . . the <br /> construction, alteration or removal of any structure. . . " in or upon <br /> a Wetland Zoning District. The Wetland Buffer Area is defined as <br /> being a part of the overall Wetland Zoning District. <br /> Following Council review in 1994, the applicant was directed to have <br /> a wetland delineation performed on the property in order to establish <br /> exact limits of the wetland area. In September of this year, Ms. Ruf <br /> provided Staff with a delineation performed by a professional <br /> engineer. In addition to the delineation, Ms. Ruf provided Staff with <br /> two (2) proposals for developing the property as single family <br /> housing. The first proposal would allow the applicant to purchase a <br /> portion of property immediately west of ' her own which is currently <br /> owned by the City via tax forfeiture. The reason for this proposal <br /> is that, although it would allow construction within the wetland <br /> buffer zone, it would do so without disturbing the existing wetland. <br /> The second proposal would involve mitigation of wetland area in order <br /> to facilitate development of the site.
