ADMINISTRATIVE POLICY <br /> CITY OF MOUNDS VIEW <br /> DRUG AND ALCOHOL TESTING POLICY IMPLEMENTING THE FEDERAL OMNIBUS <br /> TRANSPORTATION EMPLOYEE TESTING ACT AND RELATED REGULATIONS <br /> EFFECTIVE JANUARY 1, 1996 <br /> The abuse of drugs and alcohol is a nationwide problem which affects persons of every age, race <br /> and gender. The City of Mounds View recognizes that work performance and public safety <br /> problems are created when employees use or abuse controlled substances or alcohol. The City of <br /> Mounds View wishes to provide a safe workplace for its employ_ees_and-a—safe-environment-for <br /> the public which will maintain a drug and alcohol free workplace. <br /> The purpose of this policy is to establish programs designed to help prevent accidents and <br /> injuries resulting from the misuse of alcohol or use of controlled substances by drivers of <br /> commercial motor vehicles. This policy implements the requirements of the Federal Omnibus <br /> Transportation Employee Testing Act of 1991 and the U.S. Department of Transportation <br /> Regulations, 49 C.F.R., Part 382. This policy is in addition to and separate from the City's Drug <br /> and Alcohol Testing Policy, which implements the requirements of state law and the federal <br /> Drug Free Workplace Act of 1988. <br /> This policy is intended only to establish rules necessary under 49 C.F.R. Part 382. The City and <br /> its employees may have other rights and obligations under state and federal law. <br /> POLICY <br /> All employees who operate commercial motor vehicles on behalf of the City shall comply with <br /> the terms of this policy. The City requires that all employees report to work on time, either <br /> scheduled work hours or call-back, in appropriate condition for work. Any employee found to be <br /> in violation of this policy is subject to discipline up to and including termination of employment. <br /> DEFINITIONS <br /> For the purposes of this policy, the following definitions will apply: (49 C.F.R., Part 382) <br /> 1. "Accident" an occurrence involving a commercial motor vehicle operating on a public <br /> road which results in a fatality; bodily injury to a person who, as a result of the injury, <br /> immediately receives medical treatment away from the scene of the accident; or one or <br /> more motor vehicles incurring disabling damages as a result of the accident, requiring the <br /> vehicle to be transported away from the scene by a tow truck or other vehicle, (390.5). <br /> 2. "Alcohol"the intoxicating agent in beverage alcohol, ethyl alcohol, or other low <br /> molecular weight alcohols including methyl and isopropyl alcohol. ( 382.107) <br /> 1 <br />
