1 Section 5. [AUTHORITY FOR USE OF PUBLIC PROPERTY AND PUBLIC RIGHTS- <br /> 2 OF-WAY TO PROVIDE EMERGING COMMUNICATIONS SERVICES.] <br /> 3 Subdivision 1. A Person cannot offer Emerging Communications Services unless A <br /> 4 Permit is obtained from the Local Authority. <br /> 5 Application. This Act applies to every Person using public property or <br /> 6 public rights-of-way for the purpose of constructing. operating. <br /> 7 main ingoffering—or delivering-any Emerging-Communications <br /> 8 Services. <br /> 9 al A Local Authority acting pursuant to its own authority or in <br /> 10 conjunction with other political subdivisions shall require a Permit of <br /> 11 any Person subject to this Act. <br /> 12 Subdivision 2. <br /> 13 fga The PUC shall promulgate uniform statewide standards and regulations <br /> 14 to ensure that the intent and policy of this Act will be accomplished. <br /> 15 al Within 180 days after the date of enactment of this Act. the PUC shall <br /> 16 prescribe. and periodically thereafter revise regulations to carry out its <br /> 17 obligations under paragraph (a) above. <br /> 375832 -January 24, 1995 - Page 9 <br /> Prepared jointly by the law firms of Fredrikson&Byron and Bernick and Lifson <br />
