13 . Developer agrees that the City can terminate <br /> development of the development site or the construction of any <br /> building structures thereon if in the City Council' s opinion the <br /> terms of this Development Contract have not been conformed to by <br /> the Developer and sais Developer herein agrees to cease construc- <br /> tion. In addition, in the event the Developer fails to conform <br /> to the conditions of this Agreement, the City shall be entitled <br /> to enforce it pursuant to the terms of this contract and/or the <br /> provisions of the Mounds View Home Rule Charter or applicable <br /> Minnesota Statutes . The Developer herein agrees that in the <br /> event the City is compelled to enforce any of the provisions of <br /> this contract by court action and judgement is rendered in favor <br /> of the City, that all costs, disbursements and reasonable <br /> attorney' s fees will be paid by said Developer, its heirs, <br /> successors and assigns . <br /> 14 . The Developer agrees to furnish to the City at the <br /> time of the execution of this Contract a cash bond, a corporate <br /> surety bond, an irrevocable letter of credit or any other nego- <br /> tiable instrument approved by the City Attorney (the "Performance <br /> Bond" ) in the amount of $ , as required by this para- <br /> graph. The Performance Bond shall name the City as the obligee <br /> and must guarantee the Developer' s performance of the terms and <br /> conditions of this Contract, in conformance with the Contract and <br /> in compliance with the rules, regulations, statutes and ordinanc- <br /> es of the City. The Performance Bond shall also be conditioned <br /> on the Developer' s Agreement to hold the City harmless from all <br /> 5 <br />
