CRT OF <br />111706 <br />OEW <br />REQUEST FOR COUNCIL CONSIDERATION <br />STAFF REPORT <br />AGENDA SESSION DATE ,Tune 5 . 1995 <br />Agenda Section: 14. <br />Report Number: 95-1 377wS <br />Report Date: <br />DISPOSITION <br />Item Description: Discussion of Foster Care Wording (Code Amendment) <br />Administrator's Review/Recommendation: <br />- No comments to supplement this report <br />- Comments attached. <br />Explanation/Summary (attach supplement sheets as necessary.) <br />SUMMARY; <br />Within the past month, Staff has had discussions with the City <br />Attorney regarding the wording of the Municipal Code as it relates <br />to Foster Care Facilities. In particular, discussion focused on <br />the inconsistencies of the Code versus the requirements stated in <br />State Statute. <br />Currently, the Municipal Code defines Foster Care facilities as <br />facilities caring for children 16 years of age and under for <br />not more than 30 days This definition does not agree with <br />the State Statute definition which has a higher age limit (18 <br />years) and no length of stay regulation. <br />After consultation with the City Attorney, it was determined that <br />the best course of action would be to reword the applicable section <br />of the Municipal Code to require Foster Care facilities to be <br />established and operated as stipulated by State Statute. <br />(.
