COMMUNITY <br /> DEVELOPMENT <br /> TOWNSEDGE TERRACE STORM SHELTER <br /> Within the past year, Townsedge Terrace Manufactured Home Park was given City <br /> approval to construct a storm shelter on their property. At the time the site plan for <br /> the structure was reviewed, Staff located all utility services located on the property to <br /> ensure that the proposed shelter would not impact those in any way. During that <br /> review, no easements or utility services were discovered in the area of the structure. <br /> Recently, a resident of Old Highway 8 contacted the City to inform us that their <br /> service crossed the Townsedge property in the exact location where the storm shelter <br /> is to be constructed. Upon researching the residents claim, Staff discovered that an <br /> easement which should have been obtained at the time of installation of the water <br /> main at Townsedge Terrace (approximately 1967) was never obtained. <br /> Staff contacted the City Attorney and was advised that because the service has been <br /> in place for almost 30 years, the resident has certain rights to its continued use and <br /> maintenance. Therefore, Staff will be working with the Townsedge management to <br /> come up with an alternative site for the shelter. If an alternative cannot be found, an <br /> agreement regarding the relocation of the service will need to be signed by <br /> Townsedge Terrace prior to issuance of a building permit. This agreement will hold <br /> the City harmless from any claims resulting from the relocation of the service and the <br /> construction of the shelter. <br /> Staff will keep you posted on this issue. <br /> Paul <br />
