MEMORANDUM <br /> TO: Samantha Orduno, City Administrator <br /> FROM: Jennifer Bergman, Housing Inspectot b <br /> DATE: April 26, 1995 <br /> SUBJECT: Manufactured Home Park Closing Ordinance <br /> The committee appointed to work on a manufactured home park closing ordinance <br /> had their first meeting on March 21. They were given a copy of Bloomington's <br /> ordinance and MN Statute 326.95 regarding closings of manufactured home parks and <br /> met twice after that to review and make comments on the ordinance drafted for the <br /> City of Mounds View. The proposed ordinance with the committee's comments were <br /> sent to the City Attorney, Jim Thomson. <br /> After reviewing the proposed ordinance, Jim informed us the City of Bloomington and <br /> the City of Wilmar are currently in litigation over manufactured home park closing <br /> ordinances. The primary issue of the lawsuit pertains to the requirement to pay <br /> relocation costs. Because of this, he has recommended that we postpone passing <br /> this ordinance until the lawsuit is resolved. A hearing on the lawsuit has been <br /> scheduled for June. <br /> The committee agreed postponing the passing of the ordinance would be in the best <br /> interest of all parties involved given the circumstances. The concern is, however, the <br /> process could last indefinitely with the appeal process. Two committee members, a <br /> representative from All Parks Alliance for Change (APAC) and a manufactured home <br /> owner, requested the date of the Council meeting when the ordinance will be <br /> discussed so they could be present to make comments. <br />
