ORDINANCE NO. 551 <br /> CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> AN ORDINANCE RELATING TO THE PROCEDURE FOR SHUTTING OFF <br /> WATER SERVICE FOR DELINQUENT ACCOUNTS AND AMENDING TITLE <br /> 900, CHAPTER 906, SECTIONS 906. 11 AND 906. 13 OF THE <br /> MOUNDS VIEW CITY CODE <br /> THE CITY OF MOUNDS VIEW ORDAINS: <br /> Section 1. Section 906. 11, Subdivision 2, of the-Mounds <br /> View City Code is amended to read: <br /> Subd. 2 . Shut-Off by City-Grounds: " - - - - - - - <br /> the right to discontinue water 3ervicc to any customer, <br /> without notice, when nece3cary for repairo, additional <br /> connection or reconnection or for nonpayment of charges or <br /> bills or for disregard for any ru-lc3 or regulation3 in <br /> connection with the u3c or operation of caid 3yctem. Water <br /> service to a property may be shut off by the City for the <br /> following reasons: <br /> 41 Violation of a provision of this code relating to the <br /> operation, maintenance or connection to the water system. <br /> b1 Fraud or misrepresentation by an owner or occupant in <br /> connection with an application for service. <br /> ,cam Failure of an owner or occupant or to pay rates and <br /> charges for water service when due. <br /> Sec. 2 . Section 906. 11 of the Mounds View City Code is <br /> amended to add the following subdivisions: <br /> Subd. 3 . Shut-Off Procedures. If the City Administrator <br /> determines that grounds exist for shutting off <br /> water service, the administrator must notify the <br /> owner or occupant of the City's intent to shut off <br /> by mailed written notice not less than ten (10) <br /> days prior to the date of shut-off. The notice <br /> must state the reason for shutting off the water <br /> service, the date that the water shut-off will be <br /> effective and that the owner or occupant may <br /> request a hearing before the City Council and that <br /> at the hearing, the owner or occupant may present <br /> testimony as to why the service should not be shut <br /> off. The request for a hearing must be presented <br /> in writing to the City Administrator not later than <br /> the tenth day after mailing of the notice.
