a The average of the two (2) lowest acceptable bona fide <br /> Contractor's bids. <br /> b SEH'S most recent cost estimate for the project as ap- <br /> proved by the CITY upon completion of the final design. <br /> 3. The project construction cost does not include SEH'S fee, the <br /> cost of the land or right-of-way, or compensation for and/or <br /> damages to property unless this Agreement so specified, nor <br /> does it include the CITY'S legal, accounting or insurance <br /> counseling services, or interest charges incurred in connec- <br /> tion with the Project. <br /> 4. Monthly payments shall <br /> be based on SEH's current billing rates of applicable employees plus <br /> the cost of expenses and equipment as outlined in Sections V.C. and <br /> V.D. <br /> SEH will provide an estimate of the costs for the preparation of the <br /> Plans and Specifications in the Supplemental Letter Agreement. It is <br /> agreed that after 90% of costs have been incurred, SEH will notify <br /> the CITY and confer with representatives of the CITY to determine <br /> the basis for completing the work. <br /> Page No. 9 November 17, 1993 <br />
