MO522-C Page 1301. 11 <br /> advantage derived by the operation of such nonconforming use, by <br /> reason of the limitation of establishment of competing businesses <br /> as a result of this Chapter, shall be considered as a reduction <br /> of losses resulting from the requirement of termination of the <br /> use under this Chapter. <br /> Subd. 8. The Zoning Administrator shall prepare a list of those <br /> nonconforming uses which have been floodproofed or otherwise <br /> adequately protected in conformity with subdivision 1301. 12 (7) of <br /> this Chapter. He shall present such list to the City Council <br /> which may issue a certificate to the owner stating that such <br /> uses, as a result of these corrective measures, are in conformity <br /> with the provisions of this Chapter. (Ord._ 506,_ 4-27-92)____ <br /> 1301. 14 : SUBDIVISIONS' : <br /> (a) No land shall be subdivided which is held unsuitable by the <br /> City Council for reason of flooding, inadequate drainage, water <br /> supply or sewer treatment facilities. All lots within the flood <br /> plain zoning districts shall contain a building site at or above <br /> the regulatory flood protection elevation. All subdivisions shall <br /> have water and sewage disposal facilities that comply with the <br /> provisions of this Chapter and have road access both to the <br /> subdivision and to the individual building sites no lower than <br /> two feet (2 ') below the regulatory flood protection elevation. <br /> (Ord. 506, 4-27-92) <br /> (b) For all subdivisions in the flood plain, the Floodway and the <br /> Flood Fringe boundaries, the Regulatory Flood Protection <br /> Elevation and the required elevation of all access roads shall be <br /> clearly labelled on all required subdivision drawings and <br /> platting documents. <br /> (c) Removal of Special Flood Hazard Area Designation: The Federal <br /> Emergency Management Agency (FEMA) has established criteria for <br /> removing the special flood hazard area designation for certain <br /> structures properly elevated on fill above the 100-year flood <br /> elevation. FEMA's requirements incorporate fill compaction and <br /> side slope protection standards for multi-structure or multi-lot <br /> developments. These standards should be investigated prior to <br /> the initiation of site preparation if a change of special flood <br /> hazard area designation will be requested. <br /> 1301. 15:. PUBLIC UTILITIES AND FACILITIES: <br /> Subd. 1. Public Utilities: All public utilities and facilities, <br /> such as gas, electrical, sewer and water supply systems, to be <br /> located in the F. Z.D. shall be floodproofed in accordance with <br /> the State Building Code2 or elevated to above the regulatory <br /> 1. See Title 1200 of this Code. <br /> 2 . See Section 1001. 01 of this Code. <br />
