Resolution 7563, Revising Section 2.05 of the Personnel Manual in Regard to 18 <br />the Family Medical Leave Act (FMLA), by Adding a Provision on Military 19 <br />Family Leave. 20 <br /> 21 <br />Assistant Clerk-Administrator Crane presented details of the 2010 National Defense 22 <br />Authorization Act (NDAA), which expands coverage for military exigency leave and military 23 <br />caregiver leave under the Family and Medical Leave Act (FMLA). She recommended adoption 24 <br />of the draft resolution to revise the personnel manual in regard about the FMLA. A brief 25 <br />overview of the new regulations was given. 26 <br /> 27 <br />Council Member Mueller questioned how benefits would accrue if an employee was on a paid 28 <br />medical leave. Assistance Clerk-Administrator Crane explained all benefits would accrue as they 29 <br />normally do and documentation would need to be provided to meet the FMLA regulations. 30 <br /> 31 <br />MOTION/SECOND: Mueller/Hull. To Waive the Reading and Adopt Resolution 7563, 32 <br />Revising Section 2.05 of the Personnel Manual in regard to the Family Medical Leave Act 33 <br />(FMLA), by Adding a Provision on Military Family Leave and Medical Caregiver Leave. 34 <br /> 35 <br />Council Member Stigney asked if the leave of absence, Exhibit A, could read, “a leave of 36 <br />absence for qualifying exigency arising out of the fact.” be included in both definitions of 37 <br />Military Family Leave and Military Caregiver Leave. Assistant Clerk-Administrator Crane 38 <br />indicated staff would make this change. 39 <br /> 40 <br />Council Members Mueller and Hull agreed to this friendly amendment. 41 <br /> 42 <br /> Ayes – 5 Nays – 0 Motion carried. 43 <br /> 44
