Item No: 7F <br />Meeting Date: October 11, 2010 <br />Type of Business: Action <br />City Administrator Review: ________ <br /> <br />City of Mounds View Staff Report <br /> <br />To: Honorable Mayor and City Council <br />From: Heidi Heller, Planning Associate <br />Item Title/Subject: Resolution 7677, Reapproving the Final Plat, Development <br />Agreement, Conditional Use Permit and Development Review <br />of the Select Senior Living Development at Highway 10 & <br />Groveland Road <br /> <br /> <br />Introduction: <br /> <br />On October 27, 2008, the City Council passed Resolution 7347, which approved the <br />final plat and development agreement for the Select Senior Living development. This <br />was the last of the Council actions required in order for the project to move forward. Per <br />City Code, an applicant has 120 days to record the plat with Ramsey County, and if the <br />recording does not happen within this timeframe, the plat approval is void. The code <br />also states that the plat can be reapproved and the applicant given up to another 120 <br />days. Due to the shakeup within the banking industry, Select Senior Living was not able <br />to start the project within 120 days of City approval and their final plat and development <br />agreement approval became void. <br /> <br />Discussion: <br /> <br />On July 13, 2009, October 26, 2009, February 22, 2010, and June 14, 2010, the City <br />Council re-approved (for an additional 120 days) the final plat and development <br />agreement for this project. The applicant has now secured financing and will be moving <br />forward with this project, although they will not be able to complete the require plat <br />recording before the most recent re-approval expires on October 12, 2010. <br /> <br />Select Senior Living, represented by Joel Larson, has submitted a letter requesting that <br />the City re-approve their planning requests once again. Mr. Larson is asking for a 120- <br />day re-approval of the final plat and development agreement. These would then expire <br />on February 9, 2011. Also approved by the City Council in October 2008 for this project <br />was a conditional use permit and the development review. The conditional use permit <br />approval also expired due to non-use within one year. Select Senior Living also is <br />asking for re-approval of their conditional use permit to allow senior housing in a R-4, <br />high density residential district. Staff suggests that the Council also re-approve the <br />development review to help ensure there is a clear and consistent record of City <br />approvals for this project. The Planning Commission re-approved the variances for this <br />project on Wednesday, October 6, 2010.
