Mounds View City Council September 27, 2010 <br />Regular Meeting Page 4 <br /> <br /> Ayes – 5 Nays – 0 Motion carried. 1 <br /> 2 <br />ORIGINAL MOTION VOTE: 3 <br /> 4 <br />Council Member Mueller thanked Staff for presenting a thorough report on the sign issues in the 5 <br />City and for reviewing the Ordinance with Council. 6 <br /> 7 <br /> Ayes – 5 Nays – 0 Motion carried. 8 <br /> 9 <br />C. Second Reading and Adoption of Ordinance 851, an Ordinance Amending 10 <br />Chapters 502 and 503 of the Mounds View City Code about the Sale of 11 <br />Intoxicating Liquor on Sundays. 12 <br /> 13 <br />City Administrator Ericson explained the City Council adopted Ordinance 843 earlier this year 14 <br />on May 10, 2010. The ordinance made numerous changes to both Chapter 502 and 503 15 <br />regulating liquor sales in the City of Mounds View. One of the changes in Ordinance 843 16 <br />addressed liquor sales on Sundays. The City Council deleted reference to an additional license 17 <br />that could be obtained by establishments to provide for sales of alcohol from 10:00 am to noon 18 <br />on Sundays. It was staffs understanding that no licensed entity served alcohol during this time, 19 <br />since no establishment had ever requested the additional license. 20 <br /> 21 <br />City Administrator Ericson indicated it has since come to staff’s attention that both Mermaid and 22 <br />Moe’s have a history of serving alcohol on Sundays before noon, usually in conjunction with a 23 <br />brunch or some other food service. Neither owner was aware that a separate license in addition 24 <br />to the Sunday license was needed to serve for the two hours before noon on Sundays. (The State 25 <br />of MN allows for the sale and service of alcohol beginning at 10 a.m. Sundays.) While the 26 <br />original language, now deleted, seemed fairly straightforward, clearly it had been interpreted 27 <br />otherwise by two of our licensed establishments. Staff recommends approval of the second 28 <br />reading and adoption of Ordinance 851. 29 <br /> 30 <br />Council Member Mueller questioned how the local businesses would be notified of the change. 31 <br />City Administrator Ericson stated he has been in contact with the two local establishments and 32 <br />would be in further contact with them. 33 <br /> 34 <br />MOTION/SECOND: Mueller/Hull. To Waive the Second Reading and Adopt Ordinance 851, 35 <br />an Ordinance Amending Chapters 502 and 503 of the Mounds View City Code regarding the 36 <br />Sale of Intoxicating Liquor on Sundays and publish a summary. 37 <br /> 38 <br />ROLL CALL: Hull/Stigney/Mueller/Gunn/Flaherty. 39 <br /> 40 <br /> Ayes – 5 Nays – 0 Motion carried. 41 <br /> 42 <br />D.
