Minnesota Statutes require public water supply authorities to adopt and <br />enforce water conservation restrictions during periods of critical water shortages. <br /> <br />Public Water Supply Appropriation During Deficiency. <br />Minnesota Statutes 103G.291, Subdivision 1. <br />Declaration and conservation. <br />(a) If the governor determines and declares by executive order that there is a critical water deficiency, public water supply <br />authorities appropriating water must adopt and enforce water conservation restrictions within their jurisdiction that are <br />consistent with rules adopted by the commissioner. <br />(b) The restrictions must limit lawn sprinkling, vehicle washing, golf course and park irrigation, and other nonessential uses, <br />and have appropriate penalties for failure to comply with the restrictions. <br /> <br />An ordinance that has been adopted or a draft ordinance that can be quickly adopted to comply <br />with the critical water deficiency declaration must be included in the plan (include with other <br />ordinances in Attachment 7 for Part III, Item 4). Enforcement responsibilities and penalties for <br />non-compliance should be addressed in the critical water deficiency ordinance. <br />Sample regulations are available at www.dnr.state.mn.us/waters <br /> <br />Authority to Implement Water Emergency Responses. Emergency responses could be <br />delayed if city council or utility board actions are required. Standing authority for utility or city <br />managers to implement water restrictions can improve response times for dealing with <br />emergencies.
