Resolution 7405, Approving a Charitable Gambling Permit for the Blaine 7 <br />Jaycees to Conduct Charitable Gambling at Robert’s Sports Bar and 8 <br />Entertainment. 9 <br />C. Resolution 7363, Approving the Agency Delegated Contract Process 10 <br />Agreement with the Minnesota Department of Transportation. 11 <br />D. Set Public Hearing for February 9, 2009 at 7:05 p.m. for a Major Subdivision 12 <br />at Mermaid (2200 Highway 10). 13 <br /> 14 <br />MOTION/SECOND: Mueller/Hull. Resolution 7405, Approving a Charitable Gambling Permit for the Blaine 19 <br />Jaycees to Conduct Charitable Gambling at Robert’s Sports Bar and 20 <br />Entertainment. 21 <br /> 22 <br />Council Member Gunn noted the Blaine Jaycees is requesting a charitable gambling permit in 23 <br />Mounds View and asked how it benefits Mounds View. Clerk-Administrator Ericson explained 24 <br />City Code related to charitable gambling defines a trade area and that 75% of the revenue has to 25 <br />be applied to trade area. The trade area is defined as Mounds View and surrounding areas to 26 <br />Mounds View. Staff has encouraged the Blaine Jaycees to support Mounds View programs like 27 <br />Festival in the Park and other deserving organizations. 28 <br /> 29 <br />Council Member Gunn stated her understanding that Blaine requires a percentage of funds from 30 <br />charitable gambling permits to be donated to the Blaine Blazin 4th Celebration. Clerk-31 <br />Administrator Ericson explained that Robert’s indicated the previous chartable gambling 32 <br />organization no longer felt it was feasible for them to continue so the owners of Robert’s is 33 <br />looking for another organization to do so. 34 <br /> 35 <br />Council Member Mueller asked whether local agencies were notified of this vacancy and had the 36 <br />ability to apply. Clerk-Administrator Ericson stated he does not know. Council Member 37 <br />Mueller asked if consideration can be postponed for 30 days to see if other organizations within 38 <br />Mounds View would be interested. Clerk-Administrator Ericson stated he was not sure if there is 39 <br />legal justification to delay action since they meet Code and the property owners were agreeable to 40 <br />this arrangement. 41 <br /> 42 <br />Attorney Riggs stated the applicant did meet the Code; however, the Council has raised questions 43 <br />and those answers can be consider at the next meeting. 44 <br /> 45
