Item Number: 07F <br />Meeting Date: February 23, 2009 <br />Type of Business: CB <br />Administrator Review: _____ <br /> <br /> City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Desaree Crane, Assistant City Clerk-Administrator <br />Item Title/Subject: First Reading of Ordinance 817, an Ordinance Amending Title <br />500 of the Mounds View City Code Pertaining to Therapeutic <br />Massage. <br /> <br /> <br />Background <br /> <br />Due to the license revocation of the Jian Kang Massage business on January 5, 2009, <br />Staff asked the City Attorney to review the City Code pertaining to therapeutic massage <br />therapy. Specifically, Staff asked the City Attorney to review the eligibility and <br />suspension/revocation requirements to ensure there are enough parameters in the code <br />for compliance. The City Attorney proposed some language changes in the Therapeutic <br />Massage Code, and these changes were discussed at the February 2, 2009, Work <br />Session. <br /> <br />Discussion <br /> <br />Attached is Ordinance 817, drafted by the City Attorney, which revises sections 514.09, <br />514.13, and 514.14 of the Code. Many of the revisions are minor, but the main revision <br />pertains to persons ineligible to hold this type of license. The new language would <br />require the business owner to continually be of good moral character. The old language <br />would only require this when the licensed was issued. The business owner would be <br />required to continually be eligible for a Therapeutic Massage License. <br /> <br />Section 514.14 of the Therapeutic Massage Code was also revised by the City Attorney <br />in order to conform to Minnesota Statute 364.04. <br /> <br />The City Attorney will be present at this meeting to answer any questions you may have <br />about the changes. Per the City Council’s request at the February 2nd Work Session, <br />attached is the complete Therapeutic Massage Code. <br /> <br />Recommendation <br /> <br />Please review and accept the first reading of Ordinance 817. Ordinance 817 is <br />scheduled for a second reading and adoption at the March 9, 2009, City Council <br />Meeting. <br /> <br />Respectfully submitted, <br />Desaree Crane
