kennel license re-presented at this Council Meeting. Mr. Munsterman’s petition was re- <br />verified by staff, and the petition continues to need more signatures in order for the <br />petition to be valid. Many residents and neighbors withdrew their names from the <br />petition (16 total withdraws as of Thursday, March 5, 2009). Staff and City Council <br />received many complaints from resident neighbors in regard to one of Mr. <br />Munsterman’s dogs (Weinmaraner) at the February 23rd City Council Meeting. Staff <br />also informed the City Council at this meeting that there was a dog bite incident with <br />one of Mr. Munsterman’s dogs, the Weinmaraner, on December 17, 2008. Since that <br />City Council Meeting, there has been another incident with the Weinmaraner on March <br />3, 2009. Attached is the Police Report that outlines the March 3rd incident with the <br />Weinmaraner for your review. <br /> <br />A question was raised at the February 23rd City Council Meeting on how to determine a <br />vicious dog. Attached is Chapter 701 of the Mounds View City Code. Under Section <br />701.03, subd 13, a vicious animal is defined as: <br /> <br />Subd. 13. VICIOUS ANIMAL. Any animal of a ferocious or vicious <br />character, habit, disposition or any animal which has: (Ord. <br />696, 4-22-02) <br /> <br /> a. Killed or inflicted substantial bodily harm on a human, <br />domestic animal, or farm animal without substantial <br />provocation, or (Ord. 696, 4-22-02) <br /> <br /> b. Been involved in two (2) or more biting incidents without <br />substantial provocation, involving humans, domestic animals <br />or farm animals, within one (1) year. (Ord. 696, 4-22-02) <br /> <br />According to the March 3, 2009, police report, it appears that the Weinmaraner did not <br />bite the complainant. If the Weinmaraner were to bite another resident in the future, <br />then Staff may able to pursue a vicious animal violation under the Code. <br /> <br /> <br />Recommendation <br /> <br />Mr. Munsterman does not have enough signatures on the petition, and therefore, Staff <br />recommends denial of the Residential Kennel license for John Munsterman.
