COUNCIL BUSINESS 8 <br />A. 7:05 p.m. Public Hearing, First Reading of Ordinance 819, an Ordinance to 9 <br />Approve an Amendment to Chapter 7, Section 7.03 of the City Charter 10 <br />Relating to Taxation and Finances. 11 <br /> 12 <br />Clerk-Administrator Ericson presented the Charter Commission’s recommendation for two 13 <br />amendments to correct Charter language related to fees. If the Council approves First Reading 14 <br />tonight, Second Reading would be considered on April 27, 2009. 15 <br /> 16 <br />Mayor Flaherty opened the public hearing at 8:07 p.m. 17 <br /> 18 <br />Hearing no public input, Mayor Flaherty closed the public hearing at 8:07 p.m. 19 <br /> 20 <br />MOTION/SECOND: Mueller/Hull. To Waive the Reading, Approve the First Reading, and 21 <br />Introduce Ordinance 819, Amending Chapter 7, Section 7.03, of the City Charter Relating to 22 <br />Fees subject to Provisions of Section 7.03, Subdivisions 1 and 2. 23 <br /> 24 <br />Council Member Stigney questioned the ordinance wording for annual certification and if the 25 <br />increase is the total of all fees, or each individual fee. Clerk-Administrator Ericson stated staff 26 <br />interprets the intent of the language that no one fee may increase by more than 5% or the CPI 27 <br />plus 3%, whichever is less. The franchise limits the City to 4% and once the franchise expires in 28 <br />2012, it can be looked at again. Council Member Stigney stated the Charter language should 29 <br />identify and resolve that question now, not in 2012. 30 <br /> 31 <br />Mayor Marty stated this language is being recommended because it is not known what will 32 <br />happen in 2012. Clerk-Administrator Ericson stated there are two components. He explained 33 <br />that the franchise fees sunset each year by Council order so prior to this amendment, a 34 <br />referendum vote of the residents was required each year, which was not the intent of the Charter 35 <br />Commission. 36 <br /> 37 <br />City Attorney Riggs stated the explanation of Clerk-Administrator Ericson is correct. 38 <br /> 39 <br />Council Member Stigney stated the language addresses half of the question but leaves the other 40 <br />open. 41 <br /> 42 <br />The Council discussed its interpretation of the Charter amendment. 43 <br /> 44 <br />Clerk-Administrator Ericson stated he will contact the Charter Commission regarding this 45
