COUNCIL BUSINESS 8 A. 7:05 p.m. Public Hearing, First Reading of Ordinance 819, an Ordinance to 9 Approve an Amendment to Chapter 7, Section 7.03 of the City Charter 10 Relating to Taxation and Finances. 11 12 Clerk-Administrator Ericson presented the Charter Commission’s recommendation for two 13 amendments to correct Charter language related to fees. If the Council approves First Reading 14 tonight, Second Reading would be considered on April 27, 2009. 15 16 Mayor Flaherty opened the public hearing at 8:07 p.m. 17 18 Hearing no public input, Mayor Flaherty closed the public hearing at 8:07 p.m. 19 20 MOTION/SECOND: Mueller/Hull. To Waive the Reading, Approve the First Reading, and 21 Introduce Ordinance 819, Amending Chapter 7, Section 7.03, of the City Charter Relating to 22 Fees subject to Provisions of Section 7.03, Subdivisions 1 and 2. 23 24 Council Member Stigney questioned the ordinance wording for annual certification and if the 25 increase is the total of all fees, or each individual fee. Clerk-Administrator Ericson stated staff 26 interprets the intent of the language that no one fee may increase by more than 5% or the CPI 27 plus 3%, whichever is less. The franchise limits the City to 4% and once the franchise expires in 28 2012, it can be looked at again. Council Member Stigney stated the Charter language should 29 identify and resolve that question now, not in 2012. 30 31 Mayor Marty stated this language is being recommended because it is not known what will 32 happen in 2012. Clerk-Administrator Ericson stated there are two components. He explained 33 that the franchise fees sunset each year by Council order so prior to this amendment, a 34 referendum vote of the residents was required each year, which was not the intent of the Charter 35 Commission. 36 37 City Attorney Riggs stated the explanation of Clerk-Administrator Ericson is correct. 38 39 Council Member Stigney stated the language addresses half of the question but leaves the other 40 open. 41 42 The Council discussed its interpretation of the Charter amendment. 43 44 Clerk-Administrator Ericson stated he will contact the Charter Commission regarding this 45
