<br />Item No: 07F <br />Meeting Date: May 26, 2009 <br />Type of Business: CB <br />Administrator Review: _____ <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: James Ericson, Clerk - Administrator <br />Item Title/Subject: First Reading and Introduction of Ordinance 823, an Ordinance <br />Amending Chapter 702 of the Mounds View City Code by <br />Amending Section 702.02 as to the Process for the Collection <br />of Fees, Penalties and Charges Associated with Unpaid <br />Administrative Offense Penalties <br /> <br />Introduction: <br /> <br />Last year the Charter Commission recommended approval of an amendment to the City <br />Charter pertaining to Administrative Offenses and the fines associated with them. The <br />City Council enacted the amendment via approval of Ordinance 810, which was adopted <br />on July 28, 2008. (Refer to the staff report associated with Item 07E for the language <br />added to the City Charter.) <br /> <br />Discussion: <br /> <br />While the City Code already outlined the process relating to administrative offenses in <br />Chapters 202 and 702 of the City Code, the City Attorney felt additional language would be <br />needed in both chapters to ensure consistency with the Charter, and to the extent possible, <br />MN Statutes, as well as to provide some additional flexibility relating to other fines that <br />could potentially be certified as a special assessment against a property. The attached <br />Ordinance 823 makes the requisite changes to Chapter 702 as recommended by the City <br />Attorney, which clearly articulates that unpaid property-based administrative offense fines <br />may be certified to the property taxes as a special assessment. <br /> <br />Recommendation: <br /> <br />Ordinance 823 is revises language in Chapter 702.
