He stated that Condition 3 could be clarified. 1 <br /> 2 <br />Council Member Stigney stated he thought the events would be held indoors, but the Resolution 3 <br />refers to outdoor with no reference to indoor. Community Development Director Robert explained 4 <br />that a CUP is not required to sell merchandise inside the building. 5 <br /> 6 <br />Council Member Stigney asked if larger items may be auctioned inside the building even though 7 <br />on display outside. Community Development Director Roberts stated they could conduct an 8 <br />auction in that way, or hold the auction outside. 9 <br /> 10 <br />Council Member Stigney asked if the vendors could auction their merchandise. Community 11 <br />Development Director Roberts stated the auction would be conducted by the licensed auctioneer. 12 <br />Council Member Stigney asked staff to clarify that point in the Resolution. 13 <br /> 14 <br />Council Member Stigney referenced Condition 6 regarding signage and asked where the signs can 15 <br />be located, within the vendor’s rental space or along the boulevard. Community Development 16 <br />Director Roberts stated staff will clarify the language so the signage has to be within the vendor’s 17 <br />space. 18 <br /> 19 <br />Mr. Halverson stated he spoke with staff about this condition and that a City sign permit would be 20 <br />needed, which limits the number of days on display. He stated vendors will have signage inside 21 <br />their booth, but not along the boulevard. Also, the vendor’s vehicle may have a sign on it. 22 <br /> 23 <br />Council Member Stigney referenced Condition 9 indicating there would be no loudspeakers or 24 <br />public address systems. He asked if there would also be no megaphones or bullhorns. Community 25 <br />Development Director Roberts stated that was the intent. 26 <br /> 27 <br />Council Member Stigney asked if fresh fish, poultry and other meats should be available for sale, 28 <br />or just fresh produce. He also asked if the vendor will have their State license on display. 29 <br />Community Development Director Roberts stated that requirement can be added to Condition 10. 30 <br /> 31 <br />Council Member Stigney asked about payment of sales tax. Community Development Director 32 <br />Roberts stated that is part of the auctioneer’s State licensure. 33 <br /> 34 <br />Council Member Stigney expressed concern that the CUP is being considered on a permanent 35 <br />basis but he would support an interim permit so it can be operated on a trial basis and then 36 <br />reevaluated at the end of the season. Clerk-Administrator Ericson advised that an expiration or 37 <br />renewal date cannot be considered, by State Law, for CUPs. 38 <br /> 39 <br />Mayor Flaherty stated he had been assured by staff that the CUP contained enough legalese for 40 <br />review and revocation if problems occur and it doesn’t work out. 41 <br /> 42 <br />Council Member Stigney stated he would like to include language that the operation will be 43 <br />reviewed and resident input received. Clerk-Administrator Ericson stated the City Attorney is 44 <br />recommending that language not be included in the CUP; however, the Council can hold a public 45
