Code Amendments Staff Report <br />Page 2 <br /> <br /> <br />• Flammable liquids in Industrial districts (Chapter 1116.02) – the Planning <br />Commission began talking about this matter last year. Currently, the City allows the <br />storage of flammable liquids in industrial districts as a conditional use (above ground <br />storage or over 25,000 gallons below ground). This discussion began after a business <br />contacted the city because they wanted to have a 1,000-gallon tank of propane. City staff <br />thought it was unnecessary for them to go through the CUP process for that size tank but <br />as the code reads, any amount of above ground storage requires a CUP. The Planning <br />Commission came to a consensus to change the code to require conditional use permits <br />only for a combined total amount of 800 gallons or more of flammable liquid. <br /> <br /> <br />• Address 36 inch or less satellite dish antennas (Chapter 1103.18) – the city code <br />currently addresses satellite dishes, but it was written before the small three foot diameter <br />dishes became common. These small dishes must face south without any obstructions <br />which has caused residents to install them anywhere in their yards, including close to the <br />street. The Planning Commission did not want to regulate them very much, but felt that <br />they should not be installed in the right-of-way, on easements or in wetlands. <br /> <br /> <br />• Daycare centers in churches (Chapter 1106.04 Subd.1) – every church in Mounds <br />View except for Bethlehem Baptist (PUD) is zoned R-1 (churches are allowed as a <br />conditional use in R-1 districts), and at least one of the churches operates a daycare <br />center. The city code allows licensed daycare facilities in R-1 districts as a permitted use <br />but only if there are 12 or fewer persons, otherwise larger daycare centers are only allowed <br />in R-2 or higher districts. The church daycare centers probably have more than 12 children <br />in them, but they do not appear to cause problems for the neighborhoods. Staff <br />recommends adding language to the R-1 zoning district to allow daycare centers to operate <br />in public or semi-public buildings (churches, schools or community centers) as a conditional <br />use. <br /> <br /> <br />Due to the long length of some of the amendments, staff requests that the City Council see <br />the attached ordinances to review the proposed language changes. The changes are <br />indicated by deleting the stricken language and adding the underlined text. <br /> <br />The Planning Commission reviewed and discussed all of these code amendments and <br />recommended approval on June 17, 2009 and July 1, 2009.
