<br />Item No: 7H <br />Meeting Date: August 24, 2009 <br />Type of Business: CB <br />Administrator Review: ____ <br />City of Mounds View Staff Report <br /> <br /> <br /> <br />To: Honorable Mayor and City Council <br />From: James Ericson, Clerk - Administrator <br />Item Title/Subject: Resolution 7489 Approving Renewal of a Legal Services <br />Agreement with Kennedy & Graven, Chartered. <br />Introduction: <br /> <br />At the work session on July 6, 2009, the Council discussed the pending expiration of the <br />legal services agreement with Kennedy and Graven. The consensus of the Council was to <br />proceed with an extension of the agreement. <br /> <br />Discussion: <br /> <br />As discussed at the July work session, Staff analyzed Kennedy & Graven invoices for the <br />last twelve months and observed that retainer work conducted by the firm was about <br />$2,500 less than what the City pays in monthly retainer fees. This was brought to the <br />attention of the City Attorney who agreed that the monthly retainer paid by the City could be <br />reduced from $2500 per month to $2300 per month without changing the type of work <br />covered under the agreement. In addition, the Firm agreed to not increase their hourly <br />rates, given the economic climate and the reduced revenues anticipated during the renewal <br />period. The exception to this would be for work performed by the Firm that would be <br />passed reimbursed by a third party. Otherwise, no substantive changes to the legal <br />services agreement were made. <br /> <br />The term of the new agreement is proposed for three years, the same term as the previous <br />contract. It should be noted that the Agreement may be terminated for any reason by the <br />City at any time upon 30 days written notice. <br /> <br />Recommendation: <br /> <br />Staff recommends approval of Resolution 7489, a resolution approving the renewal of a <br />legal services agreement with Kennedy & Graven through August of 2012. <br /> <br /> <br />Respectfully submitted, <br /> <br /> <br /> <br />________________________ <br />James Ericson <br />Clerk - Administrator <br /> <br />
