<br />Charitable Gambling Code Amendments <br />September 14, 2009 <br />Page 2 <br /> <br />Lawful Expenditures: <br /> <br />Minnesota Statutes, 349.213, Subd. 1, allows a City to require that licensed organizations <br />contribute ten percent of their net gambling profits to the City. State law indicates that the <br />City is held to the same standards as the licensed organization regarding the expenditures <br />of these funds. (Refer to the list of lawful expenditures attached to this report.) The City is <br />also required to submit an annual report to the Gambling Control Board if it chooses to <br />collect such contributions from the licensed organizations. Desaree Crane has contacted <br />the two licensed organizations presently conducting lawful gambling in the City (Spring <br />Lake Park Lions at Robert’s and Lake Region Hockey at Moe’s) and asked both for <br />feedback on this proposed contribution. <br /> <br /> <br />Recommendation: <br /> <br />Staff recommends the Council approve the first reading and adoption of Ordinance 835, an <br />Ordinance amending Chapters 502 and 503 of the City Code relating to liquor licensing and <br />establishing a new Chapter 518 to deal specifically Lawful gambling. <br /> <br />If you should have any questions regarding the proposed revisions, please do not hesitate <br />to call me or Assistant Clerk-Administrator Desaree Crane. <br /> <br /> <br />Respectfully submitted, <br /> <br /> <br /> <br />________________________ <br />James Ericson <br />Clerk - Administrator <br /> <br />Attachments: <br />1.
