Transient merchants must display their permit in a conspicuous place on their premises. <br />Subd. 6. Hours: Peddlers and solicitors may conduct their Conducting business only between the hours <br />of before nine o'clock (9:00) A.M. and after eight o'clock (8:00) P.M. <br />Subd. 7. Remaining on the property of another when requested to leave. <br /> <br />504.07: REVOCATION OR SUSPENSION OF PERMIT: <br /> <br />Subd. 1. Cause For Revocation or Suspension: Permits issued under the provisions of this Chapter may <br />be revoked or suspended by the City Council, after notice and hearing, for any of the following <br />causes: <br /> <br />a. Fraud, misrepresentation or incorrect statement contained in the application for permit. <br /> <br />b. Fraud, misrepresentation or incorrect statement made in the course of carrying on the <br />business as solicitor, canvasser, peddler, transient merchant, itinerant merchant or <br />itinerant vendor permitted activity. <br /> <br />c. Any violation of this Chapter. <br /> <br />d. Conviction of any crime or misdemeanor. <br /> <br />e. Conducting the business of peddler, canvasser, solicitor, transient merchant, itinerant <br />merchant or itinerant vendor, as the case may be, in an unlawful manner or in such a <br />manner as to constitute a breach of peace or to constitute a menace to health, safety or <br />general welfare of the public. <br /> <br />e. Engaging in any prohibited activity as provided under Section 504.06. <br /> <br />Subd. 2. Notice Of Hearing: Notice of the hearing for revocation or suspension of a permit shall be <br />given by the Clerk-Administrator, in writing, setting forth specifically the grounds of <br />complaint and the time and place of hearing. Such notice shall be mailed, postage prepaid, to <br />the permittee at permittee’s last known address at least five (5) days prior to the date set for <br />hearing or shall be delivered by a police officer in the same manner as a summons at least <br />three (3) days prior to the date set for hearing. <br /> <br />Subd. 3. Appeal: Any person whose permit is suspended or revoked under this section shall have the <br /> right to appeal that decision as provided in Section 504.11. <br /> <br />Subd. 4. Reapplication: No permittee whose permit has been revoked shall make further application <br />until at least six (6) months have elapsed since the last previous revocation. <br /> <br />Subd. 5. Emergency Revocation: If, in the discretion of the City Council, imminent harm to the health <br /> or safety of the public may occur because of the actions of a peddler or transient merchant <br /> permitted under this ordinance, the City Council may immediately suspend a person’s permit <br /> and provide notice of the right to hold a subsequent public hearing as prescribed in <br /> subdivision 2 of this section. <br />
