355717v7 MJM MU125-65 <br />Page 9 <br />504.11: APPEALS: Any person aggrieved by the action of the Chief of Police or the Clerk- <br />Administrator in the denial, revocation, or suspension of a permit as provided in Section Sections 504.05 <br />and 504.07 of this Chapter may appeal to the Council. Such appeal shall be taken by filing with the <br />Council within fourteen (14) days after notice of the action complained of by a written statement setting <br />forth fully the grounds for the appeal. The Council shall set a time and place for a hearing on such <br />appeal within twenty (20) days, and notice of such hearing shall be given to the appellant in the same <br />manner as provided in Section 504.07 of this Chapter for notice of hearing on revocation. <br /> <br />504.12: EXEMPTIONS FROM PROVISIONS: The terms of this Chapter do not include the acts of <br />persons selling personal property at wholesale to dealers in such articles, not to newspaper carriers, nor <br />or to the acts of merchants or their employees in delivering goods in the regular course of business. <br />Nothing contained in this Chapter prohibits any sale required by statute or by order of any court or <br />prevents any person conducting a bona fide auction sale pursuant to law. <br /> <br />504.13: UNINVITED PEDDLING OR SOLICITING PROHIBITEDEXCLUSION BY <br />PLACARD OR REQUEST: It is hereby declared to be the policy of this City that the occupant or <br />occupants of the premises approached for solicitation by any person subject to this Chapter or otherwise <br />engaged in similar activities can determine whether or not the peddlers or solicitors that person shall be, <br />or shall not be, invited to their respective properties residences. Any peddler or solicitor person subject to <br />this Chapter or otherwise engaged in similar activities must immediately and peacefully leave any <br />property where the property owner has posted a sign or placard stating “No peddlers or solicitors” sign. <br />Any peddler or solicitor or other comparable statement. Any person subject to this Chapter or otherwise <br />engaged in similar activities who has gained entrance to any property residence, whether invited or not, <br />shall immediately and peacefully depart from the premises when requested to do so by the occupant. <br /> <br />504.14: VIOLATION AND PENALTIES: Any person who violates any provision of this Chapter is <br />guilty of a misdemeanor and, upon conviction thereof, shall be punished as provided in Section 104.01 of <br />this Code. <br /> <br />504.15: SEVERABILITY: If any provision of this ordinance is found to be invalid for any reason by a <br />court of competent jurisdiction, the validity of the remaining provisions shall not be affected. <br /> <br />SECTION 2.
