<br />Item No: 7C <br />Meeting Date: Sept 14, 2009 <br />Type of Business: Council Business <br />Administrator Review: ____ <br />City of Mounds View Staff Report <br /> <br />To: Honorable Mayor and City Council <br />From: James Ericson, Clerk - Administrator <br />Item Title/Subject: Second Reading and Adoption of Ordinance 834, an <br />Ordinance Amending Chapter 504 Relating to Transient <br />Merchants, Peddlers and Solicitors <br /> <br />Introduction: <br /> <br />Staff has been aware for some time that the City’s requirements relating to transient <br />merchants, peddlers and solicitors are in need of revision. Staff asked Kennedy & Graven <br />to review the regulations and to suggest revisions that would be consistent with MN <br />Statutes and recent rulings pertaining to constitutional issues. The proposed revisions are <br />attached. <br /> <br />Discussion: <br /> <br />Most of the changes proposed in the attached draft ordinance revise the code to be <br />consistent with MN Statutes and court rulings pertaining to constitutional “free speech” <br />issues. There is new language identifying those exempt from the permit requirements, and <br />a section has been added to the code which provides denial standards. The ordinance <br />requires that commercial solicitors would need a permit, non-commercial solicitors would <br />only need register with the City. Registration would consist of filling out the same <br />application but not pay a fee. Individuals engaging in non-commercial door-to-door <br />advocacy, campaigning, petitioning and the like would not need to register with the City. <br /> <br />The Council reviewed the proposed amendments at the September 8, 2009 work session <br />and made no changes to the draft ordinance. The first reading was approved on <br />September 14 with direction to clarify the language pertaining to commercial and non- <br />commercial solicitor. This has been done, as noted. <br /> <br />Recommendation: <br /> <br />Staff recommends the Council (1) approve the second reading and adoption of Ordinance <br />834, an ordinance amending Chapter 504 of the City Code, and (2) authorize staff to <br />publish an ordinance summary in the official City newspaper in accordance with City <br />Charter Section 3.07. <br /> <br />Respectfully submitted, <br /> <br /> <br /> <br />________________________ <br />James Ericson <br />Clerk - Administrator <br />
