Item No: 7C <br />Meeting Date: October 12, 2009 <br />Type of Business: Public Hearing <br />Administrator Review: ______ <br />City of Mounds View Staff Report <br /> <br />To: Honorable Mayor and City Council <br />From: Heidi Heller, Planning Associate <br />Item Title/Subject: Public Hearing, Second Reading and Adoption of Ordinance <br />836, Approving the Vacation of a Sanitary Sewer Easement at <br />the Mermaid, 2200 County Highway 10 (ROLL CALL VOTE) <br />Introduction: <br /> <br />Dan Hall, owner of the Mermaid, has applied to the City for the vacation of a sanitary sewer <br />easement that the City took in 1966 for a proposed sewer line, but never used. Mr. Hall <br />recently sold the AmericInn motel, and the buyer’s attorney requested that Mr. Hall apply to <br />the City to vacate this easement as part of the sale agreement. <br /> <br />Discussion: <br /> <br />The public works staff has reviewed this request and determined that the City changed <br />where the sewer pipe was installed, and placed it on the other side of County Highway 10 <br />instead. <br /> <br />To vacate an easement or other public interest in a parcel, the City must determine that the <br />easement no longer serves a public purpose. In this case, the City has never used this <br />easement in the 43 years that it has existed and the City has no plans to use the easement <br />in the near future. As such, there should be no negative impact with the vacation. <br /> <br />Recommendation: <br /> <br />Approve the second reading and adoption of Ordinance 836.
