<br /> <br /> <br />RESOLUTION NO. 7204 <br /> <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br /> <br />RESOLUTION DENYING A CONDITIONAL USE PERMIT TO ALLOW FOR <br />STORAGE OF FLAMMABLE LIQUIDS AT 4815 MUSTANG CIRCLE; <br />PLANNING CASE NO. CU2006-009 <br /> <br /> <br />WHEREAS, 7T’s Management, LLC. has applied for a conditional use permit to <br />allow for storage of flammable liquids; and, <br /> <br />WHEREAS, the subject property, located at 4815 Mustang Circle, is zoned I-1, <br />Industrial, and is legally described as follows: <br /> <br />Mounds View Industrial Park No. 3, Subject to Easements; Lot 7, Block 1 <br /> <br />WHEREAS, the Mounds View Zoning Code allows storage of flammable liquids as a <br />conditional use in Industrial districts; and, <br /> <br />WHEREAS, the City Council has reviewed the following documents regarding this <br />proposal: <br /> <br />1. Staff Report <br />2. Aerial View <br />3. Letters of opposition <br />4. Withdrawl request by applicant <br /> <br />WHEREAS, the City of Mounds View contracted with Futrell Fire Design & Consult, <br />Inc. to review the risk management plan submitted by the applicant. <br /> <br />NOW, THEREFORE, BE IT RESOLVED, the applicant would be required to reapply <br />to the City if they desired to move forward with this request again in the future; and, <br /> <br />NOW, THEREFORE, BE IT FURTHER RESOLVED that the Mounds View City <br />Council makes the following findings of fact related to the conditional use permit request: 1. The applicant withdrew their request for a conditional use permit on January 7, 2008. 2. The Mounds View Planning Commission recommended denial of this request on December 5, 2007 with a unanimous 7-0 vote. 3. Fire Department response time for water application exceeds the time outlined for development of extremely hazardous conditions as outlined under NFPA 58.
