Abatement of Nuisance Code Violations At 8217 Long Lake Rd Resolution 7216 Page 2 of 2 Discussion: Section 607.09 Subdivision 5 of the Nuisance Code provides the City the opportunity to reach compliance by abating (correcting) items in violation of the requirements contained within Chapter 607. In non emergency cases where no immediate threat to the public health and safety exists the City code requires that staff obtain City Council authorization prior to abatement of violations and notify the property owner of their opportunity to be heard before the council, provided however, that at least 10 days notice is provided. The property owner, Maria Preciado, resides at 8030 Long Lake road and was notified in writing on January 14 2008. Ms. Preciado contacted City staff on January 23, 2008 and explained that her son who resides at 8217 Long Lake Rd, Tony Preciado, is ill with serious complications related to diabetes and will be spending time at the Mayo clinic. Ms. Preciado explained that several other family members are ill and she has been taking care of them and this has left her with little time to correct code violations at 8217 Long Lake Rd. Ms. Preciado expressed a desire to speak before the City Council during discussion of this item. Recommendations: Staff recommends consideration of Resolution 7216 7174 authorizing abatement of Nuisance Code Violations present at 8217 Long Lake Rd. Consistent with past council directive; this resolution would authorize abatement no sooner than 5 days from the date of approval and the abatement action would be completed no later than 10 days from the date of approval.
