Abiding Savior Report <br />April 14, 2008 <br />Page 2 <br /> <br />Recommendation: <br /> <br />The County as well as the City Attorney recommends City Council adoption of a quit claim <br />deed (QCD) to formally transfer any ownership rights the City may have or may have had to <br />the Church. The City does not believe it owns this land and holds no claim to the indicated <br />land, and does not dispute the intent behind the 1970 action to release its interest in the land. <br />Approving the QCD will close the gap in the chain of title and satisfy the County’s concern <br />over the ambiguous ownership of this strip of land. <br /> <br />The actions necessary at this point to effectuate the conveyance (or possible reconveyance, <br />as it were) include adopting Resolution 7252, a resolution determining sufficiency with MN <br />Statutes Section 462.356 and Ordinance 805, an ordinance authorizing the disposal of land <br />via quit claim deed to Abiding Savior Lutheran Church. The purpose of the resolution is to <br />document the City Council’s decision to dispense with the Planning Commission’s review of <br />the proposed disposal for consistency with the Comprehensive Plan by approving a finding <br />that in the City Council’s judgment, the proposed conveyance has no relation to the <br />comprehensive municipal plan of the City. <br /> <br />Staff recommends approval of Resolution 7252 and recommends approval of the introduction <br />and first reading of Ordinance 805 as presented. <br /> <br />Please feel free to contact me should you have any questions about this request. <br /> <br /> <br /> <br />_____________________________________ <br />James Ericson <br />Clerk - Administrator <br /> <br />Attachments. <br /> <br />1.
