Item No: 7A
Meeting Date: May 27, 2008
Type of Business: PH
Administrator Review: ______
City of Mounds View Staff Report

To: Honorable Mayor and City Council
From: Heidi Heller, Planning Associate
Item Title/Subject: Public Hearing for Consideration of a Partial Vacation
of a Drainage Easement at Greenfield Estates
Apartments

Introduction:

Tycon Companies, owners of Greenfield Estates Apartments at 7521-7661 Greenfield
Avenue and 2370 County Road I, are planning to replace the existing 4 garage buildings
with 3 new garages, along with reconstructing the parking lot. In order to have a more
desirable width of the garage, and to have enough room available for exterior parking, the
garages would need to be pushed further towards the back (east side) of the property
than where they are located now.

There is a ditch that runs along the entire east side of this property – it begins from the
wetland area on the north side of Landmark Estates and runs between Greenfield Estates
and Landmark through to Bronson Drive, where it then enters underground pipes and
ends in the wetland area next to Walgreens. While creating a site plan for the new
garages, Tycon’s engineer discovered that along the east property line there is a 10 foot
drainage and utility easement on both sides of the property line, along with another
overlapping 17.5 foot drainage easement. They would like to vacate this additional 17.5
foot drainage easement in order to place the new garages 10 feet off the property line.

Bonestroo has done a review of the proposal, and the applicant is in the process of
contacting Rice Creek Watershed District since this garage and parking lot reconstruction
project will require a permit from them. Rice Creek adopted new rules in February 2008
and it will be very difficult, if even possible, for the applicant to meet these new
requirements due to site constraints. The applicant will need to work closely with Rice
Creek to see what can be done in order to make these improvements to Greenfield
Estates, but yet meet Rice Creek’s guidelines.

Recommendation:

At this time, staff is recommending that this public hearing be opened tonight, and
continued on Monday, June 9, 2008 in order to give the applicant additional time to
contact Rice Creek Watershed District.

Sincerely,
Planning Associate
