Item No. 07E Type of Business: PH & CB Meeting Date: June 9, 2008 City Administrator Review: ______ City of Mounds View Staff Report To: Honorable Mayor and City Council From: Desaree Crane, Assistant to the City Administrator Item Title/Subject: Public Hearing, Resolution 7290, a Resolution to Consider an On-Sale Intoxicating Liquor License Renewal for Totino’s Italian Kitchen located at 2535 County Highway 10 In accordance with Section 502.08 of the Mounds View City Code, a public hearing is required for all liquor license renewals. 502.08: LICENSE HEARING: No issuance of a new license, transfer of an existing license, renewal of an existing license, issuance of temporary special event or banquet licenses, or special outdoor consumption endorsements for the sale of intoxicating liquor on-sale or off- sale, club, Sunday sales or on-sale wine shall be hereafter granted by the Council until a public hearing has been conducted by the Council after published notice in the official newspaper at least ten (10) days in advance of the hearing. The City of Mounds View issued an intoxicating liquor license for Totino’s Italian Kitchen in 2007, and their renewal is before the Council for consideration. Totino’s Intoxicating Liquor License will expire June 30, 2008. The notice of this public hearing was sent out to residences within a 350 feet radius, and the Notice of Public Hearing was published in the Mounds View/New Brighton Bulletin. Property taxes on this property are current. Totino’s has submitted their city liquor license application materials and the applicable fees. The following investigations and inspections have been conducted to determine whether there is cause for the City to deny the above referenced intoxicating liquor license application: Police Inquiry and Investigations The Mounds View Police Department has issued a satisfactory report for Totino’s. Staff has submitted a background check application on the owner of Totino’s to the Minnesota Department of Criminal Apprehension. The liquor license will be contingent on a satisfactory background check. . . Utility Billing Inquiry (City of Mounds View) The Finance Department has issued a satisfactory report for Totino’s. Fire Inspection (City of Mounds View Fire Marshall) The City’s Fire Marshall is in the process of conducting final inspections on all liquor establishments. This license will be contingent on a satisfactory fire inspection.
