Mounds View City Council May 27, 2008 <br />Regular Meeting Page 9 <br /> <br />Council agreed that they would like Xcel to come up with the automatic shutoff valve as 1 <br />requested, and/or come up with an alternative measure that is equally safe for Council to review. 2 <br /> 3 <br />C. Reports of City Attorney 4 <br /> 1. Project Status Report 5 <br /> 6 <br />Attorney Riggs reviewed his memo and noted that the item on Silver Lake Woods Condominium 7 <br />Association they have indicated that they do not like the way the assessment option is written. 8 <br />He then explained that they are requesting that this state, that it is paid back over 10 years but 9 <br />statutorily, the language allows for immediate payment. The Association is asking to pay over 10 10 <br />years to bring the road up to standards, so that the City can take the street over. 11 <br /> 12 <br />Council discussed the request and agreed, as it would move the project along. 13 <br /> 14 <br />Mayor Marty asked about the CIC issue line item in the report. Attorney Riggs explained that 15 <br />the County changed the configuration of one of the lots. The County has said that they have not 16 <br />split any lots, but Staff does not agree with that. He then said that the County treated the request 17 <br />as a new plat, and allowed it to move forward despite the fact that the City did nothing on it. 18 <br /> 19 <br />Attorney Riggs indicated that he will continue to work on this, to ensure that the developer is 20 <br />aware of the fact that the City does not want any lots reconfigured over there without approval. 21 <br /> 22 <br />Council Member Mueller indicated that she would like to see this Developer work more closely 23 <br />with the City, to follow the conditions of approval rather than doing something that the City 24 <br />cannot do anything about. Attorney Riggs indicated that he does not believe that this was done 25 <br />intentionally. 26 <br /> 27 <br />12.
