Item No. 7H <br />Meeting Date: August 25, 2008 <br />Type of Business: CB <br />WK: Work Session; PH: Public Hearing; <br />CA: Consent Agenda; CB: Council Business <br />City Administrator Review _______ <br />City of Mounds View Staff Report <br />To:Honorable Mayor and City Council <br />From:Joe Rhein, Consulting Engineer <br />Item Title/Subject:Resolution 7328 Establishing the Appeal <br />Parameters for the Stormwater Infiltration <br />Program (SIP) <br />Background: <br />On July 21, 2008 the Streets and Utilities Committee passed a motion <br />recommending the basic components of the Stormwater Infiltration Program <br />(SIP) be presented to the Council for consideration and that a SIP appeal <br />process be developed. <br />On August 4, 2008 the City Council discussed the recommendations of the <br />Committee at their Work Session. Committee members were present at this <br />meeting to participate in the discussion with the Council. <br />On August 11, 2008 the City Council adopted Resolution 7319 establishing the <br />basic components of the SIP. <br />On August 18, 2008 the Committee continued discussion on the SIP, specifically <br />the appeal process. <br />Discussion: <br />Streets and Utilities Committee members presented the SIP staff report at the <br />August 4, 2008 City Council Work Session. This report included a summary of <br />the two motions passed by the Committee at the July 21, 2008 Committee <br />Meeting. The second of these two motions was passed to make the installation of <br />infiltration swales mandatory in all designated locations, with the provision that <br />individual property owners have the right to appeal the proposed location of an <br />infiltration swale adjacent to their property to the City Council for removal from <br />the SIP. <br />During discussion at the City Council Work Session on the 4th, there seemed to <br />be agreement among the Council that there should be a process for property <br />owners to appeal for removal of a specific infiltration swale from the SIP.
