SIP Appeal Process <br />As the SIP Appeal parameters recommended by the Committee are being <br />considered for approval by the Council at this meeting, staff feels that an appeal <br />process should be developed to efficiently collect and review the appeals prior to <br />presentation before Council. A potential process has been identified by staff and <br />is presented below for consideration by Council: <br />1. Staff will develop a SIP appeal form to be completed by interested <br />property owners. The form will list the appeal parameters considered by <br />the City as acceptable and allow property owners to formally state their <br />appeal to the City. <br />2. Staff will prepare a notice to all property owners located adjacent to a <br />feature identified in the finalized list of features for the 2009-2010 SUIP. <br />The goal will be to send out notices by September 5th. The notice <br />provided to property owners will include the following SIP appeal <br />information: <br />a. That SIP appeals are possible and the allowable parameters for <br />an appeal. <br />b. Contact information for property owners to both obtain the SIP <br />appeal form and officially submit the form to the City. <br />c. The deadline by which an appeal must be submitted. Staff <br />recommends that the deadline be September 26th. <br />d. Invite property owners to participate in the appeal hearing by City <br />Council at the October 13th Council meeting. <br />3. After the September 26th appeal form deadline, staff will review the <br />submitted appeals within the context of the established SIP appeal <br />parameters and provide the City Council with a staff recommendation to <br />either approve or deny a submitted appeal. <br />4. Staff will compile the results of all appeals and submit them to the City <br />Council under a single staff report. Each appeal form and corresponding <br />staff review would be included with the overall staff report, to allow the <br />City Council to discuss each appeal individually. The anticipated date for <br />consideration of the appeals by Council is the October 13, 2008 City <br />Council meeting. <br />5. Property owners submitting an appeal will be invited to participate in the <br />appeal hearing by City Council at the October 13th Council meeting, and <br />will receive a copy of the staff report outlining the recommendation from <br />staff regarding their appeal. <br />6. Council takes action on all submitted appeals at the October 13, 2008 <br />Council meeting. <br />7. The final plans for the 2009-2010 SUIP will be completed in accordance <br />with the approved appeals and presented to the City Council at the <br />November 24th Council meeting.
