The privacy fence along the north property <br />lines has been increased in height to an eight foot fence, except where it reaches the front <br />of the house at 8030 Groveland Road. City code does not allow fences taller than four feet <br />to extend beyond the front line of a house. The project engineer was able to fit in eight <br />proof of parking stalls with the new layout. The developer is currently doing soil borings for <br />Rice Creek Watershed District to determine the size and horizontal or vertical placement of <br />the underground stormwater storage containers. <br /> <br />On August 26th staff visited the 90 unit Southview Senior Housing facility in West St. Paul <br />(www.southviewseniorliving.com) that was developed by Select Senior Living and opened <br />in November 2005. In talking with their residence director, staff learned that they receive <br />two food deliveries per week, and the trash also is picked up two times per week. All of <br />these are done well within normal daytime business hours. <br /> <br />Deadline for Action: <br /> <br />This application was accepted on July 17, 2008 and in accordance with MN Statute 15.99, <br />a decision by the City shall be made within 60 days of application acceptance. The <br />deadline for City action for this request is September 15, 2008 unless the city exercises its <br />option to extend the timeline for another 60 days. <br /> <br />Recommendation: <br /> <br />After taking testimony from staff and the applicant, and holding the public hearing, the <br />Council may take the following actions related to the request: <br /> <br />1. Hold the first reading of Ordinance 813 for Rezoning, and approve Resolution 7321 for <br />a CUP, Preliminary Plat, and Development Review as requested. <br /> <br />2. Deny any of the requested actions for rezoning, preliminary plat, conditional use permit, <br />and development review. The Council should direct staff to draft a resolution of denial <br />with findings appropriate to support the denial. <br /> <br />3. Table the request. If additional information is needed before a decision can be <br />rendered or if more discussion is needed, the Council can simply move to table the <br />request until such information has been provided.
