Item No. 7D <br />Meeting Date: November 10, 2008 <br />Type of Business: CB <br />City Administrator Review _______ <br /> <br /> <br />City of Mounds View Staff Report <br /> <br />To: Honorable Mayor and City Council <br />From: Greg Halverson, Consulting Engineer <br /> James Ericson, Clerk - Administrator <br />Item Title/Subject: Second Reading and Adoption of Ordinance 804, <br />Construction Site and Land Disturbance Runoff <br />Control Ordinance (Chapter 1303) <br /> <br />Background: <br /> <br />Since March 10, 2003, the City has been required to comply with the Minnesota <br />Pollution Control Agency’s (MPCA) Municipal Separate Storm Sewer System <br />(MS4) General Permit. This permit requires the City to develop an ordinance to <br />control construction site runoff from land disturbing activities greater than or <br />equal to one acre. <br /> <br />On September 25, 2006 the City Council adopted Resolution 6937 authorizing <br />Bonestroo to prepare the ordinance for the City. <br /> <br />On October 6, 2008 the City Council reviewed a draft version of the ordinance <br />and land disturbance requirements as an agenda item of their Work Session. <br /> <br />On October 27, 2008, the City Council introduced the ordinance and approved its <br />first reading, with a few minor suggested revisions. <br /> <br /> <br />Discussion: <br /> <br />Bonestroo staff prepared an initial draft of the ordinance as directed, and then <br />worked with City Staff from the Public Works and Community Development <br />departments through several iterations of revisions and comments until the <br />ordinance reached its current proposed version. The proposed ordinance, titled <br />“Construction Site and Land Disturbance Runoff Control Ordinance”, is provided <br />as an attachment to this Staff Report. <br /> <br />City Staff feels the proposed ordinance meets the minimum requirements of the <br />MS4 permit and MPCA guidance. Staff also feels the ordinance provides <br />adequate flexibility for implementation and the appropriate enforcement <br />mechanism to control runoff to City water resources. <br />
