At that <br /> time, the City offered $12, 550 for the required easements. <br /> Mr. Beaton, on behalf of Ms. O'Neil, challenged the appraisal of the City - <br /> saying it was too low. Ms. O'Neil did not, however, object to the project <br /> in general and allowed the construction to take place by granting a Consent <br /> to Enter and Waiver of Trespass in December, 1992 . After several contacts, <br /> Mr. Beaton informed the City that a second appraisal was complete and that <br /> Ms. O'Neil would settle and sign the necessary easement for $15, 000. <br /> ' The original offer made by the City was based on :an Uncomplicated <br /> Acquisition Appraisal. If the City was to increase its original offer by <br /> 10%, the payment would be $13,805. Add to that the $500 <br /> for the owner's appraisal and d the City offer would be $14, 305 - still short <br /> of the requested $15, 000. <br /> The City's only other alternative would be to refuse the settlement offer <br /> and use condemnation to secure the easement rights. Using the per parcel <br /> figures MnDOT uses to estimate condemnation costs,. the City would probably <br /> be looking at costs exceeding $2,500. Add to this the original City offer <br /> of $12, 550 and, the total cost would be approximately $15, 050 or, more than <br /> Ms. O'Neil is now willing to settle for. <br /> /7 -------1;- )Paul Harrington,Harrington, Comm. Coordiantor <br /> RECOMMENDATION: <br /> Staff requests that the Council, by motion, authorize the Mayor to execute <br /> the Grant of Permanent Easement with Louise O'Neil in the amount of $15, 000 <br /> to be funded out of account number 499-4121-705. <br />
