The City of Mounds View will, in the implementation of their storm water system, connect <br /> to and accept the project flow at the 75th/Bronson Avenue intersection. <br /> c. The City of Fridley shall advertise the project, receive the bids and award the project to the <br /> lowest responsible bidder and shall inspect and pay the contract estimates. <br /> d. The City of Mounds View will receive a notice of the contract award and contract <br /> completion. Upon notice of the contract completion, the City of Mounds View will remit to <br /> the City of Fridley $52,000 plus one-half (1/2) of the final construction cost less $52,000. <br /> 3. Costs <br /> a. Th—e City of Fridley will be responsible for reviewing the construction estimates and paying <br /> all costs associated with the Project contract. <br /> b. The City of Mounds View shall be responsible for the $52,000 County construction <br /> contribution plus one half of the remaining final construction costs. <br /> c. The City of Mounds View shall reimburse the City of Fridley for their portion of the actual <br /> costs within 30 days of final completion notice. <br /> 4. Ownership and Maintenance Improvements - <br /> The cities shall retain ownership of the improvement project from their portion of the street <br /> centerline. Each city shall be responsible for operation, maintenance and control of their <br /> portion of the Project. <br /> 5. Disbursement of Funds: <br /> All funds disbursed by the cities per this agreement shall be disbursed per the methods <br /> provided by law. <br /> 6. Contracts and Purchases <br /> All contracts let and purchases made pursuant to this agreement shall be made by the City of <br /> Fridley in conformance with State laws. <br /> 7. Strict Accountability: <br /> A strict accountability for all funds, receipts and disbursements shall be made upon request by <br /> either party. <br /> 8. Affirmative Action: <br /> In accordance with the State Aid Affirmative Action Policy against discrimination, no person shall <br /> be illegally excluded from full time employment rights in, be denied the benefits of, or be <br /> otherwise subjected to discrimination in the program which is the subject of this agreement on <br /> - 2 - <br />
