3 . Section III of the AGREEMENT, Term of Agreement, is amended <br /> by the addition of the following: <br /> Notwithstanding any other provision of the <br /> AGREEMENT to the contrary, the AGREEMENT <br /> remains in effect until the CDBG or HOME <br /> funds and income received with respect to <br /> any three year term, or renewal term, are <br /> expended and the funded activities <br /> completed. The MUNICIPALITY may not <br /> withdraw from or terminate the AGREEMENT <br /> while it remains in effect. <br /> 4 . The second paragraph of Section V of the AGREEMENT, Special <br /> Provisions, is deleted and the following inserted in its place : <br /> Nothing in this AGREEMENT shall preclude <br /> the MUNICIPALITY from establishing a <br /> Municipal Housing and Redevelopment <br /> Authority pursuant to Minn. Stat. §§ <br /> 469 . 001 to 469 . 047 , as amended. <br /> 5 . Section V of the AGREEMENT, Special Provisions, is amended <br /> by adding the following: <br /> Pursuant to the AGREEMENT, the AUTHORITY <br /> may not fund activities in or in support of <br /> the MUNICIPALITY which does not <br /> affirmatively further fair housing within <br /> its jurisdiction or impedes the ability of <br /> the County to comply with its fair housing <br /> certification. <br /> 6 . Wherever the term "Act" appears it may mean either the CDBG <br /> Act or HOME Act, or both, depending upon the context. Wherever <br /> the term "Regulations" appears it may mean either CDBG <br /> Regulations or HOME Regulations, or both, depending upon the <br /> context. <br /> 7 . The AGREEMENT covers activities funded under both the CDBG <br /> Act and the HOME Act . The CDBG Act, HOME Act, CDBG Regulations, <br /> and HOME Regulations are incorporated herein by reference and <br /> made a part hereof . <br /> 8 . The MUNICIPALITY may not apply for grants under the Small <br /> Cities or State CDBG Programs from appropriations for fiscal <br /> years during which it is a party to the AGREEMENT or renewal <br /> terms thereof. The MUNICIPALITY may not participate in a HOME <br /> consortium except through the AUTHORITY. <br /> -2- <br />
