RESOLUTION NO. 4580 <br /> CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION NO. 4580 REQUESTING THAT THE GOVERNMENTS OF THE STATE <br /> OF MINNESOTA AND THE UNITED STATES OF AMERICA CEASE AND DESIST <br /> FROM IMPOSING UNFUNDED MANDATES ON CITIES <br /> WHEREAS, the imposition of federal and state mandates onto <br /> cities continues to occur despite outcries from villages, <br /> townships, cities and hamlets across this nation; and <br /> WHEREAS, the ability of cities to maintain their economic <br /> viability is dependent on the suspension of unfunded state and <br /> federal mandates; and <br /> WHEREAS, the United States Supreme Court has ruled in New York <br /> v. United States, 112 S . Ct. 2408 (1992) that Congress may not <br /> simply commandeer the legislative and regulatory processes of the <br /> states; and <br /> WHEREAS, many states, in reaction to more and more unfunded <br /> mandates, have declared "sovereignty under the 10th Amendment to <br /> the Constitution of the United States over all powers not <br /> enumerated and granted to the Federal government by the United <br /> States Constitution" ; and <br /> WHEREAS, the State of Colorado has adopted a resolution which <br /> served "Notice and Demand to the federal government, as our agent, <br /> to cease and desist, effective immediately, mandates that are <br /> beyond the scope of its constitutionally delegated powers" ; and <br /> WHEREAS, the City of Mounds View views unfunded federal <br /> mandates, as a violation of the Constitution as well as a negation <br /> of its rights under due process. <br /> WHEREAS, the state mandates, like federal mandates, continue <br /> to put the cities of Minnesota at risk of financial instability and <br /> further limit a city's ability to serve its citizens. <br /> NOW, THEREFORE, BE IT RESOLVED THAT the City Council in and <br /> for the City of Mounds View, Minnesota supports the belief held by <br /> countless cities across the nation that until the federal and state <br /> governments cease and desist from imposing costly, unfunded <br /> mandates on cities, the very survival of American cities is in <br /> serious jeopardy. <br />
