Mounds View City Council Page Six <br /> Regular Meeting December 14, 190 <br /> VOTE: 5 ayes 0 nays Motion Carried <br /> C. Ric Minetor, Director of Public Works/City Engineer, reviewed <br /> Staff Report No. 92-439C regarding Ordinance No. 522 Restricting <br /> the Depositing of Snow or Debris in Street Right-Of-Way. Minetor <br /> stated that this ordinance is intended to restrict the practice of <br /> plowing and/or blowing snow into the street right-of-way. Minetor <br /> further stated that debris was added as there are times when parking <br /> lots are being swept or cleaned and accumulations of dirt, leaves <br /> or other debris are left in the right-of-way or stockpiled in such <br /> a manner as to cause the material to eventually be blown or washed into <br /> the right-of-way. <br /> Councilmember Wuori asked how this addresses sidewalks. <br /> Minetor stated that sidewalks are part of the right-of-way <br /> and depositing of material on the sidewalks can be controlled. <br /> Councilmember Rickaby asked if the City has a way to enforce this <br /> ordinance? Would a fine be affixed? <br /> Minetor responded that violating this ordinance would be a petty <br /> misdemeanor and an Administrative Offense could be issued for the • <br /> violation, however, before the City would issue and Administrative <br /> Offense the property owner would be contacted to make sure that the <br /> owner is aware of the ordinance and understands what it entails. If <br /> the property owner then violates the ordinance again an Administrative <br /> Offense would be issued and if that isn't heeded a citation would then <br /> be issued. <br /> Councilmember Rickaby stated that some people contract to have their <br /> walks and driveways cleaned. Rickaby asked who would be the offender, <br /> the property owner or the contracted person. <br /> Minetor responded that the property owner would be ultimately <br /> responsible. Minetor stated that this is why contact would be made <br /> with the property owner before issuing an Administrative Offense to <br /> see if the owner could work the problem out with his contracted <br /> personnel. <br /> MOTION/SECOND: Quick/Blanchard to waive the reading and introduction <br /> of Ordinance No. 522 and schedule the second reading and Council <br /> action for December 28, 1992 <br /> VOTE: 5 ayes 0 nays Motion Carried <br /> D.
