Specal Order of Business <br /> CITY COUNCIL.FETING DATE OCTOBER 11, 1993 0 P'blic Hearings <br /> 0 Consent Agenda <br /> Zg Council Business <br /> Item Description: Consideration of Utility Construction and Use Agreement Between Mounds View- <br /> Arden Hills - Minnesota Dept. of Administration - Minnesota Dept. of Administration Facilities <br /> on County Pod I <br /> Administrator's ReviewiRecommendation: • <br /> - No comments to supplement this report <br /> - Comments attached. <br /> Explanation/Summary (attach supplement sheets as necessary.) <br /> TTMMARY; <br /> • <br /> Last year the State of Minnesota approached the City of Mounds .View with <br /> a request to extend public water utilities from a Mounds View water main <br /> to the State owned property east of 35W and County Road J. The intended use <br /> is for the Driver's Testing Center and the State's Government Surplus <br /> Center. The cost of the extension would be born entirely by the State of <br /> Minnesota. The City of Mounds View would sell its water to the State. <br /> The preliminary discussions were held this Spring with agreement from the <br /> Council (at a Work Session) that the action would be beneficial to the City <br /> of Mounds View. <br /> State law does not require a formal agreement in cases such as this, the <br /> only requirement is that the city providing the 'water and the main source <br /> inform the "jurisdictional" city (Arden Hills) that the connection will be <br /> made. This was done in the Spring. <br /> However, in order to assure both cities that the State is performing as <br /> agreed upon informally, the attached Agreement has been drafted jointly by <br /> the attorneys of both cities and addresses the concerns of Arden Hills <br /> that, at some future time, the State (if funding is received) connect to <br /> Arden Hills water source. Also, they want to be notified on a yearly basis <br /> of how much water the State is purchasing from Mounds View. The agreement <br /> further protects both cities from construction liabilities and provides for , <br /> appropriate compliance regulations. <br /> Arden Hills has approved the Agreement and our City Attorney has signed off <br /> on the Agreement. <br /> Samantha Orduno, City dministrator <br /> (-- . <br /> RECOMMENDATION: <br /> Motion to approve the Agreement and authorize the Mayor and the City <br /> Administrator to execute said Agreement on behalf of the City of Mounds <br /> View. <br />
