Mounds View City Council November 10, 2008 <br />Regular Meeting Page 7 <br /> <br /> 1 <br />C. Resolution 7353, Ordering the Public Improvement Project for Lake Court 2 <br />Drive and Lake Court Circle. 3 <br />Clerk Administrator Ericson reviewed the improvement project for Lake Court Drive and Lake 4 <br />Court Circle noting that the Association will agree to bring the streets up to City standards and 5 <br />the City will accept the streets. 6 <br /> 7 <br />Council Member Flaherty said that he is concerned about the bid amounts and whether there 8 <br />would be any issue with the City incurring additional costs. He then said that he would approve 9 <br />of moving this forward but would like to wait on the street transfer agreement. 10 <br /> 11 <br />Council Member Stigney said that in the Petition it says that the Association would have to pay 12 <br />$415,000 but the bids are not known at this time and that concerns him. 13 <br /> 14 <br />Council Member Stigney indicated that he is concerned and would like the Attorney to look into 15 <br />this before anything is signed. 16 <br /> 17 <br />Council Member Mueller said that she is concerned about Rice Creek requiring swales with this 18 <br />project because there is no public hearing on this project, because they have waived their right to 19 <br />one. She would want to know about the process if she had a swale coming to her yard. 20 <br /> 21 <br />Staff amended the Resolution to note that the Council is receiving the petition and waiver 22 <br />agreement and not an acceptance until the language is clarified. 23 <br /> 24 <br />MOTION/SECOND: Marty/Mueller. To Waive the Reading and Approve Resolution 7353, 25 <br />Ordering the Public Improvement Project for Lake Court Drive and Lake Court Circle as 26 <br />Amended. 27 <br /> 28 <br /> Ayes – 5 Nays – 0 Motion carried. 29 <br /> 30 <br />D. Second Reading and Adoption of Ordinance 804, an Ordinance Amending 31 <br />Title 1300, Flood Control Regulations, by Adding a New Chapter 1303 32 <br />Entitled Construction Site and Land Disturbance Runoff Controls (ROLL 33 <br />CALL VOTE) 34 <br /> 35 <br />Clerk Administrator Ericson reviewed the proposed Ordinance amendments. 36 <br /> 37 <br />MOTION/SECOND: Stigney/Flaherty. To Extend the Meeting to 10:30 p.m. 38 <br /> 39 <br /> Ayes – 5 Nays – 0 Motion carried. 40 <br /> 41 <br />MOTION/SECOND: Marty/Mueller.
