To Waive the Reading and Approve Resolution 7361, 5 <br />Authorizing Analysis of the Ardan Avenue Drainage Subdistrict. 6 <br /> 7 <br />Council Member Mueller said that she would like to set a not to exceed cost. 8 <br /> 9 <br />MOTION/SECOND: Mueller/Marty. To Amend the Motion to Add Item 4 with Capped at 10 <br />$9,000. 11 <br /> 12 <br /> Ayes – 4 Nays -1(Flaherty) Amendment carried. 13 <br /> 14 <br />Council Member Flaherty said that he feels the City is going to okay $9,000 to see if there might 15 <br />be a problem, which seems odd to him. He is not aware of any flooding issues in the area or 16 <br />complaints from residents to justify the work.. 17 <br /> 18 <br />Mayor Marty noted that there was a recommendation from 1989 and if the City ignores it and 19 <br />someone’s home floods then the City is going to be liable. 20 <br /> 21 <br />Council Member Mueller asked if any of the statistics from Sherwood Road drainage swales 22 <br />would be of assistance. 23 <br /> 24 <br />Mr. Rhein indicated that they need to go out and shoot low areas going up common rear lot lines 25 <br />and basement window sills, areas a little farther off the street. 26 <br /> 27 <br /> Ayes – 4 Nays – 1(Flaherty) Motion carried. 28 <br /> 29 <br />I. Resolution 7363, Approving the Agency Delegated Contract Process 30 <br />Agreement Between the City of Mounds View and the Minnesota 31 <br />Department of Transportation. 32 <br /> 33 <br />Joe Rhein, consultant engineer with Bonestroo, indicated that this agreement is required to accept 34 <br />federal funding through Mn/DOT. 35 <br /> 36 <br />Mayor Marty noted under “letting” the City may not add other work to the project without 37 <br />obtaining approval of Mn/DOT. He then asked what happens with change orders and how is that 38 <br />handled? 39 <br /> 40 <br />Joe Rhein said that there is more paperwork involved to ensure that funding is not jeopardized. 41 <br /> 42 <br />Attorney Riggs said that this Agreement needs work and he would want the Resolution amended 43 <br />to allow negotiation of the Agreement with Mn/DOT.
