He then said that he agrees with the Task Force recommendation. 1 <br /> 2 <br />Council Member Mueller said that in conversations with other elected officials and staff, a lot of 3 <br />cities are in awe of what the Streets Task Force came up with and she thinks it will be used as a 4 <br />model for other cities. She then said that she is very proud of the work everyone has done on this 5 <br />project. 6 <br /> 7 <br />MOTION/SECOND: Mueller/Marty. To Waive the Reading and Approve Resolution 7217, 8 <br />Adopting the Streets & Utilities Task Force Recommendation on Previously Assessed Properties. 9 <br /> 10 <br />Valarie Amundsen, 3048 Woodale Drive, asked if Mr. Riggs feels confident with the research 11 <br />done that it is not legal to refund old assessments. She then asked if it is legal to do what is 12 <br />proposed. 13 <br /> 14 <br />Attorney Riggs indicated that he has talked with Staff about this and under Minnesota Statute 15 <br />Chapter 429 it appears that the City can do what it is trying to do because it is a reassessment 16 <br />rather than a refund. 17 <br /> 18 <br />Council Member Stigney said that in the area of fairness is why Bronson was looked at. The 19 <br />attorney says no that we cannot do this so he accepts that. He then said that the residents should 20 <br />realize whether it comes out of the left pocket or right pocket, it doesn’t make much difference 21 <br />but if it all came out of the Medtronic levy reduction fund it would be limited to the 5% cap but 22 <br />and this way is free reign to go out and get $100/year from everyone without any cap. 23 <br /> 24 <br />Mayor Marty noted that Council Member Mueller brought up that other cities are looking at this 25 <br />model and about how this is breaking new ground and get the streets fixed with a very minimal 26 <br />cost to residents. 27 <br /> 28 <br /> Ayes – 5 Nays – 0 Motion carried. 29 <br /> 30 <br />Mayor Marty thanked the Task Force. 31 <br /> 32 <br />Council Member Mueller indicated that she would like to see the City form a Streets and Utilities 33 <br />Commission to partner with the City on the ongoing efforts to see the Resolution 7217 through to 34 <br />program completion 35 <br /> 36 <br />Mayor Marty said that he would like to refer this to the upcoming work session. He then asked 37 <br />Staff to provide information at the next work session on suggested members and term limits. 38 <br /> 39 <br />8. CONSENT AGENDA 40 <br /> 41 <br />A.
