Item No: 07C
Meeting Date: May 27, 2014
Type of Business: CB
Administrator Review: ____
City of Mounds View Staff Report
To: Honorable Mayor and City Council
From: Desaree Crane, Assistant City Administrator
Item Title/Subject: Continued Public Hearing, Resolution 8253, a Resolution to
Consider an On Sale Intoxicating Liquor License for Moe’s,
located at 2400 County Road 10

Background:

In accordance with Chapter 502 of the Mounds View City Code, a public hearing is
required for all liquor license renewals.

Application materials and fees were due to the City on May 7, 2014. On May 8, 2014,
Staff received a phone call from the owner, Mr. Moritko, and Staff granted an extension
to Wednesday, May 21, 2014. This extension was also put in writing (please see letter
dated May 9, 2014).

The notice of this public hearing was sent to the business owner and to residences
within a 350 feet radius. The Notice of Public Hearing was also published in the City’s
official newspaper.

Recommendation:

Staff recommends closing the Public Hearing. Staff recommends denial of the renewal
of Moe’s On-Sale Intoxicating Liquor License. As stated in the letter dated May 9, 2014,
if the City doesn’t receive the liquor license application materials by Wednesday, May
27, 2014, then the City will assume that this license will not be renewing. This On-Sale
Intoxicating Liquor License will expire on June 30, 2014. If Moe’s wishes to renew this
license, then they will have to go though the Public Hearing process again and submit
additional liquor application materials from the State of Minnesota Gambling and
Alcohol Division.

Respectfully submitted,

________________________
Desaree Crane
