<br />Item 9A & 9B <br />June 26, 2017 <br />Page 3 <br /> <br />The applicant has stated that planned work to take place on-site will be consistent with <br />minor automobile repair (e.g. installing bolt-on accessories onto buses, light-duty and <br />medium-duty commercial trucks), but does not want to be prohibited from conducting <br />major repair. <br /> <br /> <br />CRITERIA FOR GRANTING A CONDITIONAL USE PERMIT <br />The Mounds View Municipal Code, Section 1125.01, Subd 1(e) requires the Planning <br />Commission to consider possible adverse effects of the proposed conditional use <br />permit(s), and is described in detail within Resolution 8766 and Resolution 8768. In <br />summary, the proposed conditional use(s) are consistent with the Comprehensive Plan, <br />should have no effect on area property values, is compatible with the surrounding <br />industrial area, and has a demonstrated need by the applicant as part of the business <br />operation. <br /> <br />The Mounds View Municipal Code, Section 1125.01, Subd 3(b) states that in granting a <br />conditional use permit, the City Council shall consider the advice and recommendation <br />of the Planning Commission and the effect of the proposed use on the Comprehensive <br />Plan and upon the health, safety and general welfare of occupants of surrounding <br />lands, including Findings, where applicable. <br /> <br />These Findings are described in detail within Resolution 8766 and Resolution 8768. In <br />summary, the proposed conditional use(s) will not create a burden onto public facilities, <br />is separated or screened from residential areas (Towns Edge Mobile Home Park) by <br />the adjacent building at 4825 Mustang Cir. and will not have an adverse effect onto <br />these residential properties, is a reasonable use, is consistent with the Zoning Code <br />and Comprehensive Plan, will not cause traffic hazards, and is serviced by adequate <br />roads, public utilities, and drainage. <br /> <br /> <br />Summary <br />St. Cloud Industrial Products (SCIPI) is requesting (1) a Conditional Use Permit to <br />install three above ground fuel tanks, and (2) a Conditional Use Permit to allow major <br />automobile repair, at property located at 4821 Mustang Cir. The business customizes, <br />maintains and repairs buses and commercial vehicles. The fuel tanks will be used by <br />the business, and will not be for retail use. <br /> <br />A Public Hearing notice was mailed to property owners within 350’ of the SCIPI <br />properties (4821 & 4825 Mustang Cir.), consisting of eight owners, and published in the <br />Mounds View – New Brighton Sun Focus on June 16, 2017. <br /> <br /> <br />Planning Commission Recommendation: <br />On June 7, 2017, the Planning Commission approved Resolution 1072-17, <br />recommending approval of a Conditional Use Permit for the Storage of Flammable <br />Liquids Over 800 Gallons Above Ground. <br /> <br />
