Resolution 8777 <br />Page 3 <br /> <br />NOW, THEREFORE, BE IT RESOLVED, the City Council finds that the request is <br />consistent with the City of Mounds View Municipal Code, Title 1000 (Building and <br />Development Regulations), Title 1100 (Zoning Code), and Title 1200 (Land Subdivision), and <br />the Comprehensive Plan; and, <br /> <br />NOW, THEREFORE, BE IT FINALLY RESOLVED, based upon the above findings, <br />the information and documents regarding the proposed Preliminary Plat, the Staff Report, the <br />Planning Commission’s recommendation, testimony of the applicant, and in consideration of <br />public testimony, the City Council does hereby approve the Preliminary Plat of “Boulevard”, <br />with the following conditions: <br /> <br />1. The applicant, MWF Properties, LLC, shall comply with requirements and BMP’s, as <br />stipulated by the Mounds View Public Works Department (June 20, 2017 letter), Rice <br />Creek Watershed District (June 23, 2017 email), Ramsey County Surveyor’s office (July <br />17, 2017 email), Mounds View Community Development Department (July 18, 2017 <br />letter), and obtain applicable permits from the City, Ramsey County, Rice Creek <br />Watershed District, and any other applicable permits. <br /> <br />2. The applicant shall execute a Developers Agreement with the City, intended to be <br />completed as part of the Final Plat approval. The Developers Agreement will be <br />inclusive of developer installed improvements, including a publicly owned pedestrian <br />trail, privately owned fenced playground, landscaping and site improvements. <br /> <br />3. The applicant shall pay a Park Dedication Fee equal to 10% of the Estimated Market <br />Value (EMV) of land, current as of the date of approval of the Final Plat (2017 EMV = <br />$39,720) to the City of Mounds View prior to the City signing the Final Plat mylars. <br /> <br />4. The applicant shall submit a complete and current Title Commitment, and satisfy all <br />requirements made by the City Attorney, prior to the City signing the Final Plat mylars. <br /> <br />5. The applicant shall pay all of the City’s costs in reviewing the application, including <br />those of the City Attorney and consultants. <br /> <br />6. The applicant shall apply for Final Plat approval no later than six months after the date of <br />approval of the Preliminary Plat, or the Preliminary Plat approval will become null and <br />void. <br /> <br /> <br />Adopted this 24th day of July, 2017 <br /> <br /> <br />Carol A.
